This Privacy Policy explains how Softempower LLC (“Softempower,” “we,” “us,” or “our”) collects, uses, and shares information when you visit softempower.com or related pages (the “Site”), or contact us through the Site. It does not cover data that our customers enter into ShopTracker or other Softempower software; that data is handled under each customer’s separate agreement with us.
1.Information We Collect
Information you give us. When you fill out a contact or demo request form, email us, or call us, we collect the information you choose to provide, such as:
- your name, job title, and company name;
- your business email address and phone number;
- details about your business, such as industry, company size, and the software you use today;
- the content of your message and any preferred times for a demo.
Information collected automatically. When you visit the Site, our web servers and service providers automatically receive certain technical information, such as your IP address, browser type, device type, operating system, referring website, pages viewed, and the date and time of your visit. We use this information to operate, secure, and improve the Site.
Information from others. We may receive your business contact information from people who refer you to us, from business partners, or from public professional sources such as company websites.
2.How We Use Information
We use the information we collect to:
- respond to your questions and schedule and deliver product demonstrations;
- send you information, quotes, and proposals you request about ShopTracker and our other products and services;
- follow up about your inquiry and, if you do not opt out, send occasional updates about our products;
- operate, maintain, analyze, and improve the Site;
- detect, prevent, and respond to spam, fraud, abuse, and security incidents;
- comply with legal obligations and enforce our Terms of Use.
3.How We Share Information
We do not sell your personal information, and we do not share it with third parties for their own marketing or for cross-context behavioral advertising. We share information only in the following situations:
- Service providers. Companies that help us run our business and the Site, such as web hosting, domain and security (content delivery) providers, email and calendar services, and website analytics. They may use the information only to provide services to us.
- Legal reasons. When we believe disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of Softempower, our customers, or others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of all or part of our business, in which case the information would remain subject to this Policy.
- With your permission. In any other case where you ask us to or agree to it.
4.Cookies and Similar Technologies
The Site uses cookies and similar technologies that are necessary for it to work and to keep it secure. We may also use analytics tools that use cookies to help us understand how visitors use the Site, such as which pages are visited most. Analytics information is used in aggregate and is not used to identify you personally.
You can block or delete cookies through your browser settings. If you block essential cookies, some parts of the Site may not work properly.
5.Do Not Track and Global Privacy Control
Some browsers send a “Do Not Track” signal. Because there is no common industry standard for how to respond to these signals, the Site does not currently respond to them. We do not track visitors across third-party websites over time. If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of any sale or sharing of your personal information. As stated above, we do not sell or share personal information.
6.Email Communications
If you contact us or request a demo, we may send you follow-up and occasional product emails. You can opt out of marketing emails at any time by using the unsubscribe link in the email or by writing to info@softempower.com. We may still send you messages directly related to a request you made or an agreement you have with us.
7.Data Retention
We keep contact and inquiry information for as long as needed to respond to you, maintain our business relationship, and meet legal, tax, and accounting requirements. We generally delete or anonymize inquiry information about prospective customers that we have not interacted with in three years. Server logs are kept for a limited time for security and troubleshooting.
8.Security
We use reasonable administrative, technical, and physical safeguards to protect information, including encrypted (HTTPS) connections to the Site and access controls on our systems. No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security. Please do not send passwords, payment card numbers, or other sensitive information through the Site’s forms.
9.Your Choices and Rights
You may contact us at any time to:
- ask what personal information we have about you and request a copy;
- correct information that is inaccurate or out of date;
- ask us to delete your information, subject to any information we must keep for legal or business-record reasons;
- stop receiving marketing emails or calls from us.
To make a request, email info@softempower.com or call +1 (714) 262-4056. We may need to confirm your identity before completing your request, and we will respond within a reasonable time, generally within 45 days. We will not treat you differently for making a request.

This section is provided for California residents under the California Online Privacy Protection Act and other California privacy laws.

In the past 12 months we have not sold or shared personal information, as those terms are defined under the California Consumer Privacy Act, and we do not knowingly sell or share the personal information of anyone under 16. We do not use or disclose sensitive personal information for purposes that would require us to offer a right to limit its use.
California residents may make the requests described in Section 9, and may use an authorized agent to make a request on their behalf. We may ask the agent for proof of authorization.
California “Shine the Light.” We do not disclose personal information to third parties for their own direct marketing purposes.
11.Children’s Privacy
The Site is intended for businesses and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.
12.Third-Party Links
The Site may link to other websites and services that we do not control. Their privacy practices are governed by their own policies, and we encourage you to review them.
13.Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the “Last updated” date above. If we make material changes, we will provide a more prominent notice on the Site. Your continued use of the Site after an update means you accept the revised Policy.
